Terms of Service
These Terms of Service ("Terms") govern your access to and use of the TukWay app and website (the "Service"), operated by TukWay ("we", "us"). By creating an account or using the Service, you agree to these Terms.
1. The Service
TukWay is a platform that connects riders, customers, and independent drivers for on-demand rides, food delivery, package courier, and free-form "Magic Order" requests. TukWay is a technology platform — trips and deliveries are performed by independent drivers, not TukWay employees.
2. Accounts
- You must be at least 18 years old to create an account.
- You're responsible for the accuracy of the information you provide and for keeping your login credentials secure.
- You're responsible for activity that occurs under your account.
3. Using the Service
- Requests (rides, orders, deliveries, Magic Orders) are estimates until a driver or merchant accepts them; final pricing may reflect actual distance, time, or agreed offers.
- You agree to provide accurate pickup/drop-off information and to be reasonably available to receive your ride, order, or delivery.
- Package courier requests must not include prohibited, illegal, hazardous, or unreasonably fragile items.
- You agree not to use the Service for any unlawful purpose or to harass, endanger, or defraud drivers, merchants, or other users.
4. Drivers
Drivers on TukWay are independent contractors, not employees or agents of TukWay. Drivers must complete document verification (license, vehicle registration, national ID) before they may accept jobs, and TukWay may suspend or reject a driver at its discretion for safety, fraud, or policy violations.
5. Payments
Prices shown before you confirm a request are estimates; final charges reflect the agreed or completed trip/order. Payment methods, wallet balances, and refunds are handled as described in the app. TukWay may charge a service fee as part of the displayed price.
6. Cancellations and refunds
You may cancel a ride, order, or delivery before it is accepted or picked up, subject to any cancellation terms shown in the app at the time. Refunds for issues with a completed order (e.g. missing items, damaged packages) are reviewed on a case-by-case basis through support.
7. Prohibited conduct
You agree not to:
- Provide false information to obtain rides, orders, or driver approval.
- Interfere with the safety, security, or proper functioning of the Service.
- Use the Service to transport prohibited or illegal goods.
- Harass, threaten, or discriminate against drivers, merchants, or other users.
Violations may result in suspension or termination of your account.
8. Disclaimers and limitation of liability
The Service is provided "as is." TukWay does not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, TukWay is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including actions taken by independent drivers or merchants.
9. Changes to the Service or Terms
We may update these Terms or modify the Service from time to time. Material changes to these Terms will be notified in-app or by email before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
10. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access to the Service for violations of these Terms or for safety or legal reasons.
